Trademark Registration is most sought IP Registration as it helps you in protecting your brand name / logo of your venture. There are various Stages of Trademark Registration Status. Once your trademark application has been Accepted, the next step is to publish it in the trademark journal, and once your TM Application has got published in the trademark journal, it appears in the trademark application as "Accepted & Advertised".
“Accepted & Advertised” means that the trademark authority has accepted your mark and listed it in the trademark journal.
Accepted & Advertised allows the public to file an opposition, if any, within the prescribed time frame of four months.
Once there are no opposition, your mark gets registered under the Trademark Law.
If there is a party, who wants to oppose can do so by filing TM-O withing 4 months’ time frame and then it becomes the case of litigation.
If you have got your mark registered, you can sue anyone who copies your mark or sells their services under your brand without your permission.
When the status is "Accepted & Advertised", the applicant is not required to take any action.
If any third party opposes to the mark by filing TM-O after it is published in the journal, as a trademark applicant, you must file a counter statement within two months.
In the absence of opposition, after four months, your trademark application status is eligible to change from 'Accepted & Advertised' to 'Registered'.
If anyone opposes the mark, you are required to fight for your application by first filing a Counter Statement and then attend hearings till Opposition is removed, else your application can not get registered unless the decision is in your favour.
Well; if no one opposes within the specified time frame or if the trademark officer rules in your favour, the applicant will receive the Trademark Certificate within 1-3 months generally.
